HC cancels 350 acres land allotment to DLF in Gurgaon

dlf logoChandigarh:  The Punjab and Haryana High Court on Wednesday cancelled the transfer of 350 acres of land to realty major DLF in Gurgaon reasons citing transfer not fair, just and reasonable.  In February 2010, Haryana government had allotted land, acquired after competitive bidding, to DLF for development of a residential society, commercial facilities, sports activity and a golf course.

While a division bench of Justice Surya Kant and Justice Amol Rattan Singh directed the Haryana government to cancel the transfer of the land to DLF, it upheld the acquisition of the same land by the Haryana government done in 2003.

The court has ordered Haryana government and the Haryana State Industrial and Infrastructure Development Corporation Limited (HSIIDC) for fresh bidding of the land by inviting international bidders.

“The court has ordered that international bidders should be involved in the fresh process. DLF was free to bid for the land again,” said Sudhanshu Makkar, advocate for one of the petitioners.

DLF got the land for Rs1,750 crore. The land was acquired by the state government saying it was required for public purpose. Six petitions were filed people, mostly villagers, in Gurgaon district against the transfer of the land to DLF after acquiring it. According to the petitioners another 75 acres, acquired by HSIIDC in 1997, was also transferred to DLF in 2010 in the same manner.
